Raub Workshop Fined RM4,000 For Not Providing Written Statement Prior To Repair Work

The Magistrate Court has reportedly sentenced a workshop owner in Raub, Pahang with a RM4,000 fine or two weeks jail (if he fails to pay said fine). The offence? Failure in providing a written statement detailing the repair works and costs to be carried out on a customer’s vehicle.
According to Malaysia Gazette and a Facebook post by the Raub district’s KPDN (Ministry of Domestic Trade & Cost of Living), the accused was found guilty of violating the latter ministry’s Consumer Protection (Disclosure of Workshop Information)(Amendment) Regulations 2022.
The punishment stems from a complaint lodged by the customer who had sent his Toyota Hilux into said workshop for repairs. In his report, said Hilux owner revealed he was not given a written statement prior to the repair works carried out by the workshop, and that he was dissatisfied with the price he was charged after the repair works were completed.
Based on the facts of the case, Raub’s KPDN (ministry of domestic trade and cost of living) enforcement team conducted an investigation on the premises on August 18, 2022 after receiving a complaint,” said KPDN Pahang director Jeslily Jamaludin. He also reminded that the public is welcomed to report any suspicious activities by traders at any KPDN branch office.

As a refresher, the Consumer Protection (Disclosure of Workshop Information)(Amendment) Regulations 2022 gazetted by KPDN back in June 2022 only saw enforcement begin from July last year (2023).
Through which, it states that workshop operators must disclose a list of mechanics working, along with displaying their certifications too. On top of which, before undertaking any work, workshop operators must provide a written statement detailing if new, used, or reconditioned spare parts are used, as well as providing a guarantee for the service jobs carried out.
Offenders found guilty of these offences can be fined with a sum of up to RM50,000 (individuals) and RM100,000 (companies), or serve a three-year prison term.

This should serve as a reminder for anyone servicing their vehicles at any workshops, be it brand-authorised official 2S, 3S or 4S centres, or privately-runned third party businesses, that you are well within your rights in demanding proper consultation and estimate quotations. Following which, an agreement must be reached before any sort of work can be done.
