Car Company Wins RM54k For Water Damage Claim

A Shell petrol station operator was found liable and instructed by the Alor Gajah magistrate's court on September 30, 2023, to pay over RM54,000 to Malacha Sdn Bhd, NST has reported.
This ruling followed a lawsuit against DMY and Family Sdn Bhd, the operator of a Shell station near Sungai Petai, after a Porsche Cayenne owned by Malacha Sdn Bhd broke down due to water-contaminated V-Power 97 petrol supplied by the station two years ago, resulting in engine damage.
The car was then towed to the Porsche Service Centre, where it was discovered that the Porsche's fuel had been contaminated with water. Shell Malaysia notified the defendant of the plaintiff's complaint via email on October 3rd.

The defendant then had a technician inspect the Shell station for water leaks, but none were discovered. They further stated that no other consumers had complained since the check.
In a ruling by Magistrate Dr. Teoh Shu Yee, the defendant was found at fault for not demonstrating sufficient preventative measures, highlighting that no valid reasons or actions, like a detailed dipping report from September 30, 2023, were presented.

Instead, the defendant relied on general statements and photos, lacking actual measurement data, as reported by NST. Furthermore, the defense's claim about necessary repairs was rejected, with the court trusting the expert assessment from the Porsche Service Centre.
